It’s April 1st — Where’s the new I-9 Form?

The current Form I-9 expired on March 31, 2016.  There’s only one problem — the U.S. Citizenship and Immigration Services (USCIS) has not yet released the revised I-9 form.  This has left employers nationwide asking, “Now what?”

While the new form is not available, USCIS has taken a significant step towards releasing the new form.  On March 28, 2016, USCIS published its proposed changes to the Form I-9 for public comment.  You can directly view the proposed Form I-9, the proposed Instructions for Form I-9, and the proposed Form I-9 Supplement, Section 1 Preparer and/or Translator Certification here.

The public comment period lasts until April 27, 2016.  Assuming no changes are made, the earliest the new Form I-9 could be released is late April 2016.

In the interim, the USCIS has directed employers to continue using the current Form I-9 until the new form is released.  We will keep you updated with any developments.
