Florida Contractor Physician Group Pays $500K in HIPAA Settlement

A Florida-based contractor physician group will pay $500,000 to settle alleged HIPAA violations after data on more than 9,000 patients was posted online.

Advanced Care Hospitalists PL (ACH), which provides internal medicine doctors to hospitals and nursing facilities, has also agreed to a corrective action plan as part of the HIPAA settlement, the Department of Health and Human Services announced.

Alleged HIPAA Violations

Between November 2011 and June 2012, ACH worked with an individual who claimed to be a representative of Doctor’s First Choice Billings Inc. for billing services. Deadline to Update Grandfathered HIPAA BA Agreements Rapidly Approaching

Reminder – September 22, 2014 is the deadline for Covered Entities (CEs) and Business Associates (BAs) to revise business associate agreements that were already in place when the HIPAA Omnibus Rule was published in the Federal Register on Jan. 25, 2013.

HHS opted to grandfather BA agreements entered into prior to January 25, 2013 and which complied with the requirement in effect as of that date. CEs, BAs and subcontractors with such “grandfathered” agreements have until the earlier of September 22, 2014 (an extra one-year transition period) or the date the BA agreement is modified or renewed after September 23, 2013 to update the “grandfathered” BA agreements.
